The objective of the study was to investigate the relationship between childhood IQ of parents and characteristics of their adult offspring. It was a prospective family cohort study linked to a mental ability survey of the parents and set in Renfrew and Paisley in Scotland. Participants were 1921-born men and women who took part in the Scottish Mental Survey in 1932 and the Renfrew/Paisley study in the 1970s, and whose offspring took part in the Midspan Family study in 1996. There (...) were 286 offspring from 179 families. Parental IQ was related to some, but not all characteristics of offspring. Greater parental IQ was associated with taller offspring. Parental IQ was inversely related to number of cigarettes smoked by offspring. Higher parental IQ was associated with better education, offspring social class and offspring deprivation category. There were no significant relationships between parental IQ and offspring systolic blood pressure, diastolic blood pressure, cholesterol, glucose, lung function, weight, body mass index, waist hip ratio, housing, alcohol consumption, marital status, car use and exercise. Structural equation modelling showed parental IQ associated with offspring education directly and mediated via parental social class. Offspring education was associated with offspring smoking and social class. The smoking finding may have implications for targeting of health education. (shrink)

This Note is intended to stand as a short supplement to the compelling article by Stefan Vogenauer entitled, ‘A Retreat from Pepper v Hart? A Reply to Lord Steyn’ published in the Journal at the end of 2005.1 In his article, Professor Vogenauer calls in question the argument advanced by Lord Steyn in his article in the Journal, entitled ‘Pepper v Hart: A Re-examination’.2 In that article, Lord Steyn called for a retreat from the decision of the House (...) of Lords in Pepper v Hart3 concerning the circumstances in which reference may be made to Hansard as an aid to statutory construction and for a reinterpretation of the decision in line with a theory that a Minister speaking in Parliament who gives an explanation of the meaning or effect of a clause in a Bill should be taken to create a binding legitimate expectation that the executive will apply the provision, once enacted, in that sense. In this Note, I express my agreement with Professor Vogenauer’s argument, and seek to support it with some additional points under three heads: (1) the proper interpretation of Pepper v Hart and its status as authority; (2) the basis in principle for adhering to that interpretation; and (3) conceptual difficulties attached to Lord Steyn’s legitimate expectation thesis. This article re-examines the House of Lords» decision in Pepper v Hart, which relaxed the rule prohibiting courts from using ministerial explanations of Bills in Parliament in the construction of statutes. It recognizes the importance of context in the interpretation of statutes, but questions the assumption in the case that intention can be attributed to Parliament. It argues that the case can be confined to authorizing the use of ministerial statements in Parliament when such statements can be shown to (...) be inconsistent with arguments made by government before the courts on the meaning of the legislation. Any broader interpretation of the decision raises serious constitutional objections. (shrink)

The article seeks to instantiate the distinctive features and basic research strategies in legal ontology as they are presented in the early works by the famous Oxford philosopher of law Herbert Hart, published before his major book The Concept of Law. The author tries to isolate the most salient aspects of the analytical legal tradition applicable to Russian legal theory, which can bridge the existing gap between these approaches despite considerable difference both in their background and methodology.

The unifying factor is a combinatorial principle which we present in terms of a game in which the first player challenges the second player to carry out constructions which would be much easier in a generic extension of (...) the universe, and the second player cheats with the aid of ♦. Quoique leibniz donne l'apprence de baser sa philosophie sur le principe de l'identite, c'est pourtant sur celui de la raison suffisante qu'il insiste le plus dans son oeuvre. ce principe de la raison suffisante joue un role majeur parce que leibniz derive sa conception de la substance d'une analogie entre le sujet et les attributs des propositions et les concepts de substance et leurs attributs. cette analogie mene a une theorie de retenue de la verite et a une autre qui (...) affirme que les attributs sont inherents a la substance: theories compatibles avec la raison suffisante mais non avec celle de l'identite. leibniz n'a ps compris la conception de la substance chez spinoza dans laquelle les attributs sont identiques a la substance. le raisonnement de leibniz contre spinoza n'est donc guere convainquant. je suggere que la raison de ce malentendu ne releve pas uniquement de la logique de leibniz, mais aussi d'une theologie basee sur une ame d'une immortalite qui persiste et sur la theorie d'une morale vengeresse. The paper discusses the Anglo-American philosophy of law of the 20th century, more specifically the philosophy of law of Ronald Myles Dworkin and his criticism of the legal positivism of Herbert Lionel Adolphus Hart. The author presents the history of the criticism of legal positivism in Ronald Dworkin’s philosophy of law and distinguishes historical stages. The subject of the study is the critique of legal positivism but not the Hart-Dworkin debate itself, well known in Western philosophy of law. (...) The reason is that the discussion was conducted between Dworkin and Hart’s supporters but not between Dworkin and Hart by himself. The latter responded to the criticism only after twenty seven years. The article explains why Dworkin chose for his criticism Herbert Hart’s version of legal positivism. This is due to the fact that Dworkin highly appreciated Hart’s positivist theory of law and characterized it as the “most clear.” The article presents the methodological foundations of criticism of Hart’s legal positivism in Dworkin’s philosophy of law. It reveals a methodological divergence between the two legal theories, which directly affects the understanding of the concept of law and its content. Therefore, we can assume that the legal theories of Hart and Dworkin are two competing models of law: Dworkin’s model considers law as a set of rules and principles and Hart’s model acknowledges only rules and court decisions as a source of law. The article also presents the key principles of positivism criticized by Dworkin. These principles, firstly, interpret law as a set of legal rules determined through a special legal criterion, secondly, provide the judge with an opportunity to make a decision “at his own discretion” in a situation not regulated by law, and, thirdly, recognize only legal rights and obligations enshrined in legal regulations. It is important to note that in this article the author describes criticism as an independent phenomenon of legal philosophy with a particular focus on the history and foundations of this phenomenon. The article examines K.A. Rodin’s thesis on the possibility of including Wittgenstein’s remarks on intention and action in the context of legal philosophy research. It is shown that although the concepts of intention and intentional action are relevant to the philosophy of law, Wittgenstein’s own ideas did not have a significant impact on their relevance (and some of them did not have it at all). This influence is confined to the fact that, like Wittgenstein, many jurists and legal theorists, mainly (...) those who were influenced by the ideas of H.L.A. Hart, also objected to the causal theory of action. However, the influence is limited to this approach. (shrink)

This paper presents the ordination of these women, and tries to clarify the role of ministry played out in different places on the island, according to three hagiographic testimonies: Acts of Heraclides, Vita Epiphanii, Vita Auxibii.

Sono descritte le vite e, per quel che permettono le fonti a noi giunte, le opere delle donne pitagoriche (in questo intervento si fa riferimento alle donne vissute dal VI al IV secolo a.C., nelle prime comunità pitagoriche della Magna Grecia), di Maria l’Ebrea alchimista alessandrina, per alcuni storici vissuta tra il I e il III secolo, per altri prima di Cristo, (...) di Ipazia di Alessandria vissuta tra i IV e V secolo, uccisa tragicamente e, martire eroica, divenuta simbolo della libertà di pensiero femminile. La letteratura veneziana degli anni Trenta del Cinquecento è caratterizzata da una volontà di reazione nei confronti della tradizione letteraria precedente. Gli effetti delle guerre d’Italia e la conseguente discesa di Carlo V comportò profondi cambiamenti politici e culturali e una decadenza del sistema delle corti. Autori come Aretino, Speroni e Piccolomini furono tra i primi a cogliere questi mutamenti, scrivendo opere che polemizzano nei confronti di testi ambientati a corte come gli Asolani di Bembo e il Cortegiano di Castiglione. (...) Un aspetto che accomuna questa produzione letteraria è rappresentato dal ruolo preminente che viene affidato ai personaggi femminili. Nei Ragionamenti di Aretino, nella Raffaella di Piccolomini e nel Dialogo d’amore di Speroni, le donne diventano lo strumento principale per esprimere opinioni nuove e polemiche nei confronti delle ipocrisie e delle idealizzazioni del mondo della corte. Nel presente articolo, si evidenzieranno gli aspetti più importanti di queste opere, mostrando come la scelta di personaggi femminili non risponda ad una semplice moda letteraria ma derivi piuttosto da ragioni ideologiche. 최근 우리에게 부각된 『크리톤』의 해석적 과제는 의인(화된) 법률연설의 위상과 의미인데, 권위와 복종의 문제에 대한 하트(V. Harte) 등의 문제제기에 제대로 답해야 한다. 바람직함이 당연시되는 민주주의 역시 숙고의 대상인데, 거기에 이용될 만한 자산인 플라톤은 친민주-반민주 이분법 도식 하에 민주주의 반대편에 정위되어 둘 사이의 만남은 아주 제한적으로만 논의되어 왔다. 이 글은 이런 해석적, 실천적 과제에 부응하면서 『크리톤』에서 드러나는 민주주의에 관한 플라톤 철학의 적극적 함축의 실마리들을 탐색하려 시도한다. 우선 작품 서두가 부각하는 은밀함을 화두 삼아 소크라테스가 선생이나 조언자가 아닌 시민으로 설정됨을 확인하고, 이런 설정이 『변명』에서 (...) 『크리톤』전반부, 그리고 후반부로 이어지는 일련의 ‘소크라테스의 하강’과 그것을 관통하는 ‘로고스에 대한 복종’을 부각하기 위한 것임을 밝힌다(2절). 이어 전반부 대화와 후반부 법률 연설을 시민 소크라테스가 참여하는 두 대화 모델, 즉 대칭적 관계에서의 설득 모델과 비대칭적 관계에서의 설득 모델이라는 측면에서 조명한다. 먼저 전문가주의적 신념을 가진 소크라테스가 다중의 의견을 존중하는 크리톤과 나누는 대화인 전자에서는 당대 민주주의 절차와 정신에 대한 의식적 반성과 반영이 이루어진다는 점을 음미한다(3절). 그리고 법률에 빙의한 자신과의 대화인 후자에서는 민주주의 하 시민이 권위에 대한 복종을 ‘권위주의적’이지 않은 방식으로 받아들이는 과정이 재현된다는 점에 주목하는데, 특히 법률 연설이 전반부 논의와 연속적이며 ‘하물며’ 논법과 ‘자기 설득’이라는 장치 등에 의해 전반부 논의에 긴밀히 통합된다는 점을 선명히 하면서 하트 등 웨이스(R. Weiss) 식 해석의 강한 지점을 공략한다(4절). 끝으로 소크라테스의 하강과 은밀함을 통해 이 작품이 결국 플라톤 정치철학의 시작점과 끝점에 위치한 『변명』과 『법률』을 연결시키는 접점으로 드러난다는 점을 부각한다(5절). (shrink)

Cet article traite de christianisme ancien, de littérature apocalyptique et de gnose, trois champs de recherche liés à ma recherche doctorale, dans le but de discuter de leur réception dans l’espace public contemporain. Les différents exemples donnés dans ce texte montrent bien que cet espace public contemporain est toujours friand de sujets religieux, en particulier dans les domaines cités. Il est vrai que cet intérêt a été moussé par des ouvrages de fiction et des livres qui utilisent le christianisme comme (...) arrière-plan, mais sans être au courant des recherches actuelles. Le rôle du chercheur en sciences des religions apparaît donc crucial et reste au centre de l’ensemble des considérations réunies ici. (shrink)

This chapter, which deals with the notions of affectivity and engagement, explores the internal connection between basic affects to get at the emergence of affectivity. Additionally, it presents a discussion of motivation and the interplay of affectivity and engagement. Basic affects consist of needs, wants, and desires. Needs and then wants involve a kind of circumspective seeing in which ‘felt’ values are as much a part of objects as their utility. Intentions-in-action are rooted in basic affects. The basic types of (...) affects are each triadically structured with the moments of each type being dyadically organised. The affectivity circuit usually begins with what is not yet a profile coming to prominence out of a dark background. The circuit of engagement is inducted by a bodily drive seeking resolution. Les v. 12-24, centrés sur lui, ont suscité l’empathie du lecteur et certains acquis de lecture l’ont préparé à cet accueil. La surprise du récit se trouve dans l’intervention du fils aîné: son arrivée et le sommaire (...) du v. 27 révèlent le décalage entre cette fête et celles évoquées au début du chapitre 15: la thématique ‘perdu / trouvé’ et la dimension collective de la fête ont ici disparu. Alors que l’aîné est pris dans une logique de rétribution, le père évoque la fraternité en plus de la filiation, le basculement de valeurs en plus de la rétribution. L’irruption du fils aîné, en provoquant un décalage entre l’attente du lecteur et la situation racontée, est l’occasion de réaffirmer l’importance du retournement provoqué par «trouvé / perdu». Ce changement-là permet d’entrer dans la vraie joie, celle du royaume. Le retour du cadet n’est donc pas ce qui exclut l’aîné de la fête, mais au contraire ce qui permet la fête, et permet à l’aîné d’y être invité. (shrink)

Following A. V.Hill, those formulae are developed in a mathematical research which are of interest in the field of physiological diffusion processes in cylindrical objects.At first, an introduction into the problem is given. Then a development follows of the mathematical methods which are suitable for the integration of the partial differential equation of the diffusion.The special part contains the investigation of problems which are importance for the physiology of respiration. Thus the query is answered for the concentration of a substance (...) in dependance of time and place for the diffusion in tissue cylinders taking into consideration a constant rate of consumption, as well as the query of the temporal alteration of the average concentration. The cylinder fed from the outside and the one fed from a central capillary must hereby be specially treated according to the boundary conditions. The developed equations are explained by special examples and numerical lists. Further, the steady state of supply of tissue cylinders is investigated in case that apart from the radial also an axial diffusion component has to be counted with. The numerical results from the developed formulae are in good agreement with the values found by experiments.Suivant A. V.Hill on a développé dans une étude mathématique les formules qui se rapportent aux procédés de diffusion dans la physiologie.Pour l'introduction, on donne une explication des problèmes. Puis on fait suivre le développement mathématique qui permettent l'intégration de l'équation différentielle de la diffusion.Dans la partie spéciale, on étudie des problèmes concrets de la physiologie respiratoire. Pour la diffusion dans des cylindres cellulaires on a trouvé le résultat de la concentration d'une substance en dépendance du lieu et du temps où on a tenu compte à une consommation constante. De même, on a réussi a résoudre le problème du changement temporel de la concentration moyenne. Il est nécessaire de traiter en particulier le cylindre dans des conditions spéciales c'est-à-dire quand il est approvisionné du dehors et d'un tube capillaire et central . On a expliqué les équations différentielles par des cas spéciaux et par des tableaux numériques. Puis on a étudié la provisionnement stationnaire des cylindres cellulaires en cas que outre la composante de diffusion radiale, il faut tenir compte à une composante de diffusion axiale . Les résultats obtenus par les formules développées correspondent bien aux valeurs trouvées par les expériences. (shrink)

It has been argued by Hull and others that a remnant of essentialism impeded taxonomic progress until systematists abandoned attempting to define taxa on the basis of characters necessary and sufficient for group membership. The advent of cladistics suggests instead that it is an essentialistic view of characters, not of taxa, that should be abandoned, and that only a transformational view of characters allows evolutionary novelties to be identified, much less explained. Conventional Darwinian explanations are not tautologous but are difficult (...) to test and scarcely explain evolutionary novelties, probably because of their emphasis on genetic rather than epigenetic (developmental) processes. Au livre V de l'Éthique à Nicomaque, Aristote ne donne pas une définition unifiée de la justice. Tout en ne rejetant pas la définition traditionnelle qui identifie la véritable justice et la justice légale, ni celle qui repose sur la justice naturelle et fonde la notion d'équité, il cherche de nouvelles assises pour la justice institutionnelle et c'est la notion d'égalité qui sert à cette fin. Cet article vise à préciser les notions de stricte égalité et d'égalité proportionnelle et corrélativement (...) à analyser les définitions des justices distributive et directive qui constituent les branches de la justice particulière chez Aristote.In the Fifth Book of the Nicomachean Ethics, Aristotle does not give one unified definition of justice. He does not reject the traditional definition of legal justice nor the definition of natural justice which is necessary to dread the idea of equity. However, he wants to ground institutional justice on a new base and the idea of equality serves this end. In this paper, I want to make clear the difference between strict and proportional equality and correlatively to analyse the definitions of distributive and "directive" justices which form the two branches of the aristotelian particular justice.
